Terms and Conditions of Trade

Please read these carefully. Before we can carry out any work on your vehicle you will be asked to sign to confirm that you have read and agreed to these Terms and Conditions.

1. Definitions

1.1 We/Us/Our means 1st Glass Automotive Glazing Ltd (Company Number 5710631) whose registered office is Unit 21, Warren Close, Stone, Aylesbury, Bucks, HP17 8YL.

1.2 You/Your/Yourself means the person or business as detailed and signed on behalf of on the Customer Work Sheet.

1.3 Services means the automotive glass repair or associated services requested by You to be provided by Us as detailed in the Customer Work Sheet.

2. Nature of the Terms

2.1 You acknowledge that the services will be provided to You on these Terms and at the price referred to on the Customer Work Sheet and that these Terms shall govern the agreement between You and Us for the provision of the service to the exclusion of all other terms.

3. The Services

3.1 We shall provide the services in a timely and professional manner and You agree to promptly provide Us with such assistance as We may reasonably request to assist Us in the provision of the Services. If You fail to do so or provide Us with inaccurate or incomplete information, We cannot be held liable for any delay, cost or other consequence that may arise.

3.2 You confirm that Your vehicle has been inspected before any work has been undertaken by Us and that any damage indicated on the Customer Work Sheet is correct.

4. Payment

4.1 In return for the provision of the Services, You agree to pay Us as specified on the Customer Work Sheet plus VAT at the prevailing rate (if your business is located in the UK). Payments should be made by cash, cheque or credit/debit card immediately upon provision of the Services unless We have agreed to credit facilities.

4.2 Where We have agreed credit facilities, payment should be made within 30 days of the provision of the Services. Where a credit account is in place and no price is shown You agree to pay Us for the Products and Services listed on the Customer Work Sheet at the prices agreed at account setup. We shall be entitled to charge interest on overdue accounts at 5% per month and to suspend Services without notice or cancel Services if payment from You becomes overdue (or if You being a company has a receiver appointed or goes into liquidation or being an individual commits an act of bankruptcy or has a receiving order against them). In addition We reserve the right to charge an administration fee should payment fail to be made, resulting in a court summons. Such fee to be in addition to legal costs and interest.

5. Risk/Title

5.1 Automotive glass replacements (“Replacements”) supplied by Us are at Your risk from delivery. Ownership of such Replacements shall not pass to You until You have paid Us in full. Until ownership has passed to You, You must hold Replacements on trust for Us and not destroy or obscure any identifying marks on the Replacements.

5.2 Your right to possession the Replacements shall terminate immediately if a resolution is passed for Your winding up, or any insolvency proceedings are commenced by or against You, or You make arrangements with Your creditors or have an administration receiver appointed.

5.3 We shall be entitled to recover payment for Replacements notwithstanding that ownership of Replacements has not passed from Us.

5.4 You grant Us an irrevocable license at any time to enter any premises where Replacements are or may be stored in order to inspect them, or where Your right to possession has terminated to recover them, this includes removing glass from your vehicles.

6. Liability

6.1 We shall not be liable for any loss or damage which You may suffer as a result of relying upon Our advice or recommendations unless We have materially breached these Terms or acted with gross negligence in providing such advice/recommendations in which case Our liability shall be limited to the value of the Services. In no event shall we be liable for indirect or consequential loss or damage, including loss of profits, caused by any such breach of contract or negligence.

7. Warranty

7.1 All automotive glass replacements carry a 1 year warranty covering installation and workmanship including leakage.

7.2 To make a claim under the warranty, please call 08458 620960 to enable Us to rectify Our Services. We will not be liable for the cost of third parties rectifying Our Services.
